TERMS & CONDITIONS

1. Scope

These Terms & Conditions apply to direct sales of original artworks by Maria Weigt to private or business customers, unless otherwise agreed in writing.


2. Artwork and Contract

All artworks are original works of art. Minor variations in colour, texture and appearance may occur depending on lighting, screen settings and the materials used.

A purchase agreement is concluded when the buyer agrees to purchase the artwork and the artist accepts the sale. The buyer will receive an invoice for the agreed purchase price.


3. Prices and Payment

All prices are stated in euros unless otherwise agreed.

Payment terms and available payment methods are agreed individually with the customer.

The artwork remains the property of Maria Weigt until full payment has been received.


4. Collection and Delivery

Collection, delivery or shipping arrangements are agreed individually.

Any additional transport, packaging, insurance or shipping costs will be communicated before the purchase is completed.


5. Returns and Withdrawal

For artworks purchased in person after the buyer has had the opportunity to view the artwork, no voluntary right of return is granted.

Statutory rights in the event of defects remain unaffected.

Where a statutory right of withdrawal applies, for example in certain distance sales or contracts concluded outside the artist’s business premises, the applicable legal provisions shall apply.

Custom-made or clearly personalized commissioned artworks are generally excluded from the statutory right of withdrawal where permitted by law.


6. Condition and Warranty

Statutory warranty rights apply.

Original artworks are individually created objects. Natural variations, minor irregularities, visible brush marks, textures, material structures, colour variations and other characteristics resulting from the artistic process or materials used do not constitute defects.

Damage resulting from improper handling, storage or unsuitable environmental conditions after delivery does not constitute a defect for which the artist is responsible.


7. Copyright and Reproduction Rights

Copyright and all reproduction rights in the artwork remain with the artist, unless expressly agreed otherwise in writing.

The purchase of an original artwork transfers ownership of the physical artwork only and does not include any rights to reproduce, publish, distribute, commercially exploit or otherwise use the artwork.

The artist retains the right to reproduce the artwork, including for prints, publications, promotional purposes, digital presentation or other artistic and commercial uses.


8. Applicable Law

German law applies, subject to any mandatory consumer protection provisions applicable in the customer’s country of residence.
